Counsel tab

This tab is used to identify the attorneys who are representing the corresponding case participants. Similar to the Participants tab, the attorneys must be added to the filing or verified that they already appear. Excluding instances in which the submitter is pro se, the primary step that needs to be completed in this tab is the identification of the attorney responsible for the PACFiling.

Submitting Attorney does not appear on the Counsel tab

If the submitting attorney is not listed by default on the Counsel tab, they must be added manually. This is initiated through the Add Self icon Add Self icon or the Add Counsel icon Add Counsel icon, each of which opens a popup screen. In this popup, complete one of the two processes below to add an attorney:

Add Self

1.

In the Add Self popup screen, click the radio button that appears next to your name, or the attorney you are proxying for, and click the SELECT button. This action displays an expanded version of the Add/Edit Counsel popup screen that features two tabs related to the selected attorney.

2.

In the Contact Information tab, verify the name and contact details for the attorney. The information displayed is based on what is on file with the Pennsylvania Disciplinary Board. The attorney’s name and bar number cannot be edited, but any of the other information can be changed as it applies to the PACFiling.

3.

After reviewing this information, click on the Representing tab and select the checkbox for the case participant(s) that the attorney is representing.

4.

Click the SAVE button to add this attorney to the Counsel tab. You can repeat this entire process as many times as necessary in order to add other attorneys to the filing.

Add Counsel (other than self)

1.

There are three ways to search for the attorney: by Pennsylvania bar number, last name, or the law firm to which they are associated. Click on the Search Type dropdown to select the type of search you want to complete.

2.

Click in the field below the Search Type field, enter the corresponding bar number, last name, or law firm name, and click the SEARCH button to display your results.

3.

From the search results, locate the name of the appropriate attorney, click the radio button that appears next to their name, and click the SELECT button. This action displays an expanded version of the Add/Edit Counsel popup screen that features two tabs related to the selected attorney.

4.

In the Contact Information tab, verify the name and contact details for the attorney. The information displayed is based on what is on file with the Pennsylvania Disciplinary Board. The attorney’s name and bar number cannot be edited, but any of the other information can be changed as it applies to the PACFiling.

5.

After reviewing this information, click on the Representing tab and select the checkbox for the case participant(s) that the attorney is representing.

6.

Click the SAVE button to add this attorney to the Counsel tab. You can repeat this entire process as many times as necessary in order to add other attorneys to the filing.

When the information displayed for all counsel has been verified or updated appropriately, click the NEXT button to continue.

Submitting Attorney is listed on the Counsel tab

If you, or the attorney you are proxying for, is listed in this tab by default, then the only recommended action is to verify the accuracy of the submitting attorney's contact information. Clicking the View/Edit icon View/Edit icon next to the submitting attorney's name opens the Add/Edit Counsel popup screen where you can edit the address information as needed. The information displayed is based on what is on file with the Pennsylvania Disciplinary Board. The attorney’s name and bar number cannot be edited, but any of the other information can be changed as it applies to the PACFiling.

Removing an Attorney

For various reasons, there are instances where the attorney listed for the moving participant is incorrect because the participant's representation changes when the case is filed in the Commonwealth Court. Consequently, any attorney appearing by default, as a result of their participation on the lower tribunal case, can be removed by clicking the Delete icon Delete icon that appears next to their name. Any attorneys that were added manually can also be removed if they were added in error.
